Mark Misell was a trolley porter at the supermarket in Shoeburyness, Essex, for 30 years.

He has learning difficulties and can’t read or write but was allegedly fired for a single offence – smoking in the car park rather than the smoking area.

Mr Misell is being supported by the GMB Union, which has accused Asda of discrimination against workers with disabilities.

Mr Misell is being supported by the GMB Union, which has accused Asda of discrimination against workers with disabilities.

He added: ‘Gone are the days when Asda would respect their workforce and support those with disabilities.

‘It is becoming common practice for colleagues with disabilities to be challenged upon their work rate, work speed or matters to which they have no control.’

Mr Dixon added that Asda customers have contacted the supermarket after hearing about his dismissal.

The union boss said their legal team will take the matter to an employment tribunal ‘so that justice can be achieved for Mark’.

Mr Dixon said: ‘Asda need to change their ways and reconsider the decision made.’

An Asda spokesperson said: ‘We do not comment on individual colleague circumstances and we have advised Mr Misell and his representatives as to the next steps following the final hearing last week.’ Here
